What Happened With the Texas THC Ban?
Hey itâs me Drodie, crazy how things go, Texas has officially banned several hemp-derived cannabinoid variants, including THCA flower, effective July 31, 2026. The Texas Supreme Court cleared the way for the Texas Department of State Health Services (DSHS) to reclassify these compounds as Schedule I substances. That means compounds added to the Schedule I list are treated similarly to marijuana under Texas law.
The decision is another major chapter in the ongoing battle between the hemp industry and state regulators.
For cannabis consumers, this creates confusion because not every THC product is affected the same way.

Which THC Products Are Illegal in Texas?
Products containing cannabinoids that Texas has specifically classified as Schedule I are generally not legal to manufacture, sell, or possess unless an exception applies.
Examples can include certain intoxicating hemp-derived cannabinoids that regulators have targeted, such as:
What is banned?
The ban applies to all synthetically created THC forms, including delta-8, delta-10, THCP and THCA flower. The one exception will be delta-9 products with less than 0.3% THC by dry weight.Because litigation and enforcement policies can change, consumers should always verify the current status before purchasing.

What THC Products Are Still Legal in Texas?
The good news?
There are still hemp products that remain federally legal under the 2018 Farm Bill when they also comply with Texas law.
Generally, these include:
CBD Products
CBD oils
CBD gummies
CBD creams
CBD tinctures
CBD capsules
Products must stay within legal THC limits and meet state requirements.
Hemp Products Containing Less Than 0.3% Delta-9 THC
Many hemp-derived products remain legal if they contain no more than 0.3% Delta-9 THC by dry weight and otherwise comply with Texas regulations.
Always check:
Third-party lab results
Certificate of Analysis (COA)
Reputable brands
Texas compliance
Hemp Flower
Some hemp flower products remain available if they comply with federal and Texas hemp laws. However, consumers should be aware that products marketed as high-THCA hemp may face additional legal scrutiny depending on changing state interpretations and enforcement.
This area continues to evolve.

What About THCA in Texas?
THCA has become one of the biggest topics in cannabis.
Although THCA itself is non-intoxicating until heated, Texas regulators have increasingly focused on products that can convert into Delta-9 THC when smoked or vaporized.
Because of ongoing legal developments and changing enforcement, the legality of high-THCA hemp products in Texas remains uncertain and can change quickly.
If you live in Texas, it's important to stay up to date before purchasing THCA flower or concentrates.
